The Supreme Court quashed a rape case against a 25-year-old man accused of having a sexual relationship with a married woman under a false promise of marriage.
The Court held the relationship was consensual and the woman was already married when it began, making any such promise illegal and unenforceable. The bench found no evidence of fraudulent intent or inducement, noting the woman maintained the relationship for over a year, even visiting lodges.
Citing misuse of rape laws and principles from Bhajan Lal’s case, the Court concluded the FIR lacked merit and quashed it under Section 482 CrPC.
